Terms of service

Last updated: September 2026

We know — nobody reads Terms & Conditions. But Germany takes this stuff seriously (very seriously), and honestly, so do we. So here it is: the legal stuff, written like humans.

1. Who We Are

Natalia Kalugina
(trading as „Hyped Society“)
Brüsseler Straße 49
13353 Berlin
Germany

Email: achso@hypedsociety.co

We're based in Berlin. Yes, we have an Impressum. Yes, we paid someone to help us with this. Welcome to doing business in Germany.

2. How a Contract Is Formed

When you place an order, you're making an offer to buy. You'll get an automatic confirmation email — but that's just us saying "Alles klar, wir haben's gesehen." It's not a binding confirmation yet.

The contract is formed once we confirm your order is accepted. We reserve the right to cancel orders in exceptional cases — stock issues, payment problems, that kind of thing. It's rare, but it happens. If it does, we'll let you know and sort out a full refund.

3. Prices and Payment

All prices are shown in euros (€). We currently operate as a small business under the German Kleinunternehmerregelung (§19 UStG) — no VAT is charged or shown separately, the price you see is the total price.

We accept credit cards including Visa, Mastercard and Maestro, Apple Pay, Google Pay, Shop Pay, PayPal, and Klarna.

Payment is due at the time of order. We don't store your card details.

4. Shipping

Right now we ship within Germany. Europe is coming — turns out sending a tote bag across a border involves more forms than the tote bag.

Costs are shown at checkout before you confirm anything. Shipping is free on orders over €120.

Every item is printed individually — made for you, not mass-produced in advance like fast fashion. That's not slow, that's intentional. Your order usually ships within 5 business days. During peak seasons, for larger or more complex orders, or if something goes sideways at production, it can take up to 14 business days. Once it's handed to the carrier, delivery within Germany normally takes another 2–4 days. If anything is running long, we'll reach out.

5. Right of Withdrawal (EU Customers)

If you're an EU consumer, you have a statutory 14-day right of withdrawal — no reason needed. Changed your mind, wrong size, your cat looked at it funny — doesn't matter.

The full conditions, timelines, exceptions and how to actually exercise your right of withdrawal (including the official withdrawal form) are set out in full on our Refund Policy page — that's the authoritative version, so check there before you email us.

6. Defective or Incorrect Items

Got something broken or not what you ordered? Email us at achso@hypedsociety.co within 14 days of delivery, with a photo. We'll replace it or refund you — whatever works best for you. This is just our fast-track process — your statutory warranty rights under German and EU law (Sachmängelhaftung) last much longer and are not affected by this.

7. Intellectual Property

All designs, graphics, and content on this website belong to Natalia Kalugina (Hyped Society) and are protected by copyright. You can wear our stuff, gift it, love it — but you can't reproduce or sell our designs. That's not very Berliner of you.

Buying a product doesn't transfer any IP rights to you.

8. Limitation of Liability

We are liable without limit for damage caused intentionally or through gross negligence, for injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz).

For damage caused by ordinary (slight) negligence, we are only liable if we breach an essential contractual obligation — meaning an obligation whose fulfillment makes it possible to carry out the contract at all, and on whose fulfillment you, as our customer, may reasonably rely (for example: actually delivering the product you paid for). In that case, our liability is limited to the damage that was foreseeable and typical for a contract of this kind at the time it was made.

Beyond the cases listed above, liability for ordinary negligence is excluded.

None of this affects your statutory rights as a consumer under German and EU law.

9. Dispute Resolution

We're not obliged to participate in formal consumer arbitration proceedings before a consumer arbitration board (§ 36 VSBG) — but honestly, just email us first. Most things can be sorted over email without anyone lawyering up.

10. Governing Law

These terms are governed by the laws of the Federal Republic of Germany — ja, natürlich — excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If you're an EU consumer, you also benefit from mandatory consumer protection laws in your country of residence.

11. Changes to These Terms

We may update these terms occasionally. The version live at the time of your order is the one that applies.
